In the following, we inform you about the collection of personal data in the case of business transactions.1

(a) Collection, Storage and Disclosure of Data

We shall collect, store, and possibly disclose the data, if required, in order to render the contractual services. The collection, storage and disclosure thus occur for the fulfilment of the contract and on the basis of Art. 6 (1) sentence 1 (b) GDPR. The failure to provide such data may mean that the contract cannot be concluded. When we deliver goods to you, we will forward your data to the contracted shipping company if such data is required for the delivery. Any further processing will only take place if you have provided your consent to it or legal permission is provided.

We sometimes also make use of external service providers for the processing of your data which are based in the European Economic Area. We chose such service providers with care and attention, entered into written contracts with them, and require them to follow our instructions. We verify them on a regular basis. The service providers will not disclose such data to third parties but shall erase them after the fulfilment of the contract and the expiration of the legal storage deadlines unless you have provided your consent to a period of storage extending beyond such deadlines.

(b) Payment Data

Your payment data will be transferred to the corresponding payment services provider according to your chosen method of payment. The payment services provider is responsible for your payment data. Information regarding the data controller of the payment services provider, the contact details of the Data Protection Officer of the payment services provider and the categories of personal data which are processed by the payment services provider are available at the following internet address www.ksk-koeln.de.

(c) Purchase on Account / Credit Check

You are also welcome to pay for your order on account. We wish to point out that if this payment method is chosen, we shall complete an assessment of the credit risk on the basis of a statistical mathematical procedure at the following credit agency: Creditreform Solingen Kirschner GmbH & Co. KG, Kuller Str. 58, D-42651 Solingen (www.creditreform-solingen.de) (this is also referred to as "scoring"). In this respect, the personal data necessary for the credit check, including the company name, possible name, date of birth, address and banking details will be transferred to the credit agency, in the context of which your address details will also be considered. The collection, storage and disclosure thus occur for the purposes of the credit check and to avoid default of payment, and on the basis of Art. 6 (1) sentence 1 (b) GDPR and Art. 6 (1) sentence 1 (f) GDPR.

On the basis of this information, a statistical probability for a credit default and therefore your capacity to pay is calculated. If the credit check is positive, an order on account is feasible. If the credit check is negative, we will not be able to offer you the payment on account services.

You can object to the transfer of these data to the credit agency at any time. If you do so, however, it will no longer be possible for you to place an order on account using our website. The extent of the scoring is solely limited to whether an order on account is feasible. We only use the scoring so that we are protected against possible cases of default of payment.

It is possible that we may also transfer information regarding non-claim-related behaviour which casts doubt on your trustworthiness (in the case of fraud, for example) to the credit agency Creditreform Solingen Kirschner GmbH & Co. KG, Kuller Str. 58, D-42651 Solingen (www.creditreform-solingen.de). This will take place according to the legal requirements insofar as it is necessary for the safeguarding of our legitimate interests and the legitimate interests of third parties, and no reason exists to assume that your interests, basic rights and basic freedoms, which require the protection of personal data, take precedence. The collection, storage and disclosure thus occur for the prevention of fraud and on the basis of Art. 6 (1) sentence 1 (f) GDPR.

Information about the source from which the personal data originate and, if applicable, whether they originate from publicly accessible sources, is available from our internet address www.selbach.com and also from the credit agency at the following internet address www.creditreform-solingen.de.

(d) Technical Protective Measures

We use the current technical measures for the protection of your personal data. We consistently make sure that these measures are adapted according to the state of the art.

(e) Your Rights

You have the right to request information about the personal data regarding your person that we have saved (Art. 15 GDPR). This also relates to the recipients or categories of recipient to whom such data are forwarded and the purpose of the storage. In addition, you have the right:

  • to rectification (Art. 16 GDPR)
  • to erasure (Art. 17 GDPR)
  • to restriction of processing (Art. 18 GDPR)
  • to data portability (Art. 20 GDPR)

Personal data will only be saved for the duration required for the achievement of the corresponding purpose; this is generally equivalent to the duration of the contract or the period which is stipulated by a legal provision (retention period).

In the case of the processing of personal data for the performance of a task carried out in the public interest (Art. 6 (1) sentence 1 (e) GDPR) or for the purpose of legitimate interests (Art. 6 (1) sentence 1 (f) GDPR), you can object to the processing of personal data regarding your person at any time with future effect. In the event of an objection, we must refrain from all further processing of your data for the aforementioned purposes, unless

  • there are compelling legitimate reasons for the processing which override your interests, rights and freedoms, or
  • the processing is for the establishment, exercising or defence of legal claims.

You can object to the use of your data for the purposes of direct advertising with future effect at any time; insofar as it is associated with such direct advertising, this also applies to profiling. In the event of an objection, we must refrain from all further processing of your data for the purposes of direct advertising.

You are also able to lodge an objection with regard to issues relating to data protection at the responsible supervisory authority.
